That the Seaboard Coast Line Railroad Company violation the controlling
agreement, in particular Rule 23 of the current agreement effective
January 1, 1968 as amended, when Electrician B. E. Everingham was
unjustly assessed twenty (20) demerits for alleged violation of
Master Mechanic's bulletin dated March 5, 1980, file - Personnel:
General, issued to all Mechanical Department Employes at the Tampa
Division on June 26, 1980 at Tampa, Florida.
2. That accordingly, the Seaboard Coast Line Railroad Company clear the
personal record of Electrician B. E. Everingham of the twenty (20)
demerits and all reference to this matter be stricken from his personal
record.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
