Dispute: Claim of Employes:
1. That the Seaboard Coast Line Railroad Company violated the controlling
agreement effective January 1, 1968, in particular Rule 4(c), 7(a)
and 46(b) when Communications Maintainer G. T. Langston was required
to perform work when no emergency existed and not properly compensated
for same on January 12, 1979.
2. That accordingly, the Seabord Coast Line Railroad Company compensate
Communications Maintainer G. T. Langston in the amount of one (1)
hour and thirty (30) minutes at the overtime rate for service required
after his normal work day on January 12, 1979.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
