Dispute: Claim of Employes:
1. That the Seaboard Coast Line Railroad Company violated the controlling
agreement, in particular Rule 1, 23(e) and Appendix "Q" of the current
agreement effective January 1, 1968, as amended, when Shiploader
Operators J. M. Taylor, W. L. Lewis and 0. B. Fields, positions were
unjustly suspended May 9, 1980 through May 20, 1980 at Carrier's
Rockport Phosphate Facility.
2.
Statement:
That accordingly, the Seaboard Coast Line Railroad Company compensate
Shiploader Operators J. M. Taylor, W. L. Lewis and 0. B. Fields for
eight and one-half (8k) eight (8) hour days wages, at the straight
time rate, wages lost from May 9, 1980 through May 20, 1980. Seven (7)
hours wages at the overtime rate, wages lost May 15 and 16, 1980 due
to overtime being worked and Claimants not being called.
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
