( Southern Pacific Transportation Company (Pacific Lines)
Dispute: Claim of Employes:
1. That under the current Agreement, Maintenance of Way Department
Electrician T. P. Daly was unjustly treated when he was dismissed from
service on September 28, 1979, following investigation for alleged
violation of Rule 810 of the General Rules and Regulations of the
Southern Pacific Transportation Company (Pacific Lines). Said alleged
violation occurring during the months of July and August 1979.
2. That accordingly, the Southern Pacific Transportation Company (Pacific
Lines) be ordered to:
(a) Restore Electrician T. P. Daly to service with all rights
unimpaired including service and seniority, loss of
wages, vacation, payment of hospital and medical insurance,
group disability insurance, railroad retirement contributions,
and loss of wages including interest at the rate of six percent
(6I) per annum.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
