Dispute: Claim of Employes:
1. That under the current Agreement, Mechanical Department Electrician
D. L. Muston was unjustly treated when his discipline record was assessed
sixty (60) demerits on December 16, 1980, following formal investigation
for alleged violation of portion of Rule "M" of the General Rules and
Regulations of the Southern Pacific Transportation Company (Pacific
Lines). Said alleged violation occurring on November 6, 1980.
2. That accordingly, the Southern Pacific Transportation Company (Pacific
Lines) be ordered to:
(a) Rescind the sixty (60) demerits assessed Electrician D. L.
Muston's discipline record.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
