Dispute: Claim o f Employes:
1. That the Illinois Central Gulf Railroad violated Rule 39 of the
Schedule "A" Agreement between the Illinois Central Gulf Railroad
and the International Association of Machinists & Aerospace
Workers, when they suspended Machinist C. S. Pope from the
service of the Company for 30 days beginning July 14, 1981,
through August 13, 1981.
2. That, accordingly, the Carrier be ordered to:
(a) Pay Machinists Pope 22 days pay at the Machinists' pro
rata rate.
(b) Clear his service record of all reference to the charges
° made against him by Mr. R. G. Richter under date of June
16, 1981, and the discipline subsequently assessed on July
13, 1981.
(c) Grant all benefits obtained for
Machinists in
any agreements
between the Company and the International Association
of Machinists made subsequent to Machinist Pope's suspension
which he would have received had he not been suspended
from service beginning July 14, 1981, through August 13,
1981.
(d) Make Machinist Pope whole for all losses incurred as result
o f his suspension from service July 14, 1981, through
August 13, 1981.
Statement:
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex pane form, hearing thereon was waived, and the Division is now in
receipt of a request from the Carrier that the case be withdrawn.
