Parties to Dispute:
(The Illinois Central Gulf Railroad Company
Dispute: Claim of Employes:
1. That the Illinois Central Gulf Railroad violated Rule 39 of the
Schedule "A" Agreement, dated April 1, 1935, made between the
Illinois Central Gulf Railroad and the International
Association of Machinists & Aerospace Workers, AFL-CIO, when
they suspended Machinist O. C. Stampley from service for ten
working days beginning July 18, 1981, and concluding July 29,
1981.
2. That, accordingly, the Carrier be ordered to:
(a) Compensate Machinist Stampley ten days pay at the
Machinists pro rata rate for the period he was suspended
from service beginning July 18, 1981, and concluding on
July 29, 1981.
(b) Clear Claimant's personal record of all reference to the
charges filed against him on May 20, 1981, and investigation
conducted on July 8, 1981.
(c) Grant all benefits obtained for Machinists in any future
agreements between the Illinois Central Gulf Railroad and
the International Association of Machinists to which
Machinist Stampley would have received had he not been
suspended from service.
(d) Make claimant whole for all losses incurred as a result
of his suspension from service from July 18, through July
29, 1981.
Statement:
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parte form, hearing thereon was waived, and the Division is now in
receipt of a request from the Carrier that the case be withdrawn.
