Parties to Dispute:
(The Illinois Central Gulf Railroad Company
Dispute: Claim of Fmployes:
1. That the Illinois Central Gulf Railroad violated Rule 39 (but
not limited thereto) of the Schedule "A" Agreement between the
Illinois Central Gulf Railroad and the International Association
of Machinists and Aerospace Workers, AFL-CIO, when they terminated
set-up Machinists Apprentice L. E. Dilate from service on
July 7, 1981.
2. That accordingly, the Carrier be ordered to:
(a) Reinstate Mr. Dilate to service, seniority rights unimpaired.
(b) Pay all back wages, including overtime, lost from the time
Mr. Dilate was terminated until such time as he is reinstated
to service.
(c) Pay premiums on Travelers Policy GA-23000, I1lnois Central
Gulf Hospital Association, Provident Insurance Policy P-5000,
and Aetna Policy GD-12000 while held from service.
(d) Make claimant whole for all vacation and holiday rights.
(e) Make Mr. Dilate whole for all losses incurred to him as result
of his dismissal.
(f) Pay 10% interest on all back wages.
Statement:
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex pane form, hearing thereon was waived, and the Division is now in
receipt o f a request from the Carrier that the case be withdrawn.
