Z. That the Illinois Central Gulf Railroad violated the controlling
Schedule "A" Agreement, particularly Rule 39, but not limited
thereto, between the Illinois Central Gulf Railroad and the
International Association of Machinists & Aerospace Workers,
AFL-CIO, when they suspended Machinist Prentiss Gnoden from the
service for 10 work days beginning Sunday, May 31, 1981,
through Saturday, June 13, 1981.
2. That accordingly, the Carrier be ordered to allow:
(1) Ten (10) days pay at the Machinists' pro-rata rate in behalf
of Machinist Gooden.
( 2) Machinist Gooden 's work record cleared of any and all
reference to anything pertaining to his suspension from
service on May 31, 1981, through June 13, 1981.
Statement:
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parse form, hearing thereon was waived, and the Division is now in
receipt of a request from the Carrier that the case be withdrawn.
