Dispute: Claim of Employes:
1. That the Houston Belt and Terminal Railway Company violated Rules 22
(a) and (b), 99, and 100 of the September 1, 1949 controlling agreement,
and, Article III of the September 25, 1964 Agreement when they assigned
Carman J. H. Qualls anal Carman J. D. Smith between 12:00 noon and 1:00
p.m. on March 11, 1980 to disconnect battery cables and remove 2-trays
of batteries from Carrier's Engine N25, and, between 7:00 a.m. to 12
noon on March 12, 1980 to install the 2-trays of batteries to said
engine.
2. That, accordingly, Carrier be ordered to compensate Electrician J.
Burney and Electrician O. A. Wooldridge two hours and forty-minutes
(2'40") at the overtime rate for each day for Tuesday and Wednesday -
March 11 and 12, 1980.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Employes that the case be withdrawn.
