That the Houston Belt and Terminal Railway Company violated Rules 22,
23 (a), 100, and 102 of the September 1, 1949 controlling agreement
when they assigned Laborer Pryor between 12 noon and 3:00 p.m. on
Saturday, November 7, 1981, to operate the overhead electric traveling
crane to remove batteries from Belt Unit 31 thereby depriving Electrician
J. Burney of his contractual rights to said work under the provisions
of the Agreement at Houston, Texas.
2. That, accordingly, Carrier be ordered to compensate Electrician J.
Burney two hours and forty minutes (2'40") at the overtime rate for
Saturday, November 7, 1981.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Employes that the case be withdrawn.
