Dispute: Claim of Employes:
1. That the Houston Belt and Terminal Railway Company violated Rules 22,
23 (a), 99, 100, and 102 of the September 1, 1949 controlling agreement
when they assigned Laborer Johnny Pryor and Laborer Berry Baker between
7:00 a.m. and 3:00 p.m. on Saturday, October 31, 1981, to operate the
overhead electric traveling crane to change traction motor for Belt
Unit 34 thereby depriving Electrician J. Burney and Electrician O.
Wooldridge of their contractual rights to said work under the provisions
of the Agreement at Houston, Texas.
2. That, accordingly, the Carrier be ordered to compensate Electrician J.
Burney and Electrician O. Wooldridge eight (8) hours at the overtime
rate for Saturday, October 31, 1981.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Employes that the case be withdrawn.
