Dispute: Claim of Employes:
1. That Machinist W. H. Peters was issued a Trial Notice for the
 
following charges:
 
"Your theft and unauthorized possession of Company
 
tools removed from Juniata Locomotive facilities and
 
found in your garage by Conrail Police at approxi
 
mately 3:05 PM, February 6, 1981.
 
Unauthorized possession of Company material, namely
 
one single chime horn and one 1/2 inch Rockwell impact
 
wrench, found in your locker, Juniata Locomotive
facilities, at approximately 5:45 PM, February 6, 1981."
2. That, accordingly, Machinist W. H. Peters' record be cleared
and he be compensated for each and every day he was dismissed;
and seniority.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a request
from the Employes that the case be withdrawn.
