Dispute: Claim of Emplyes:
1. Carman Brian L. Cron was deprived of his right to employment
when Carman R. D. Atchison, junior in respect to seniority, was
recalled to service on October 12, 1982.
2. Carrier violated Article V 1(a) of the August 21, 1954 Agreement
when the Division Manager failed to respond to appeal dated
January 26, 1983.
3. That the Chicago and North Western Transportation Company be
ordered to restore Carman Brian L. Cron to Carrier service at
Kansas City, Missouri, with all rights to which he is entitled,
dating from October 12, 1982.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Employes that the case be withdrawn.
