Dispute: Claim of Employes:
1. That the Carrier under the working agreement assigned four (4) maintenance
of equipment, hereinafter referred to as M. of E., sheet metal workers
to perform work covered by Rule 2, Part B of the Memorandum of Understanding
of November 23, 1954. This work assignment consisted of installing
duct work and brackets for duct work on October 13, 1980.
2. That, accordingly, the Carrier be ordered to additionally compensate
sheet metal workers T. R. Bryan, Russell Division and A. R. Hicks,
Ashland Division maintenance of way, hereinafter referred to as M. of
W. sheet metal workers, in the amount of eighty four (84) hours each
straight time to be divided among them for this work.
Findings:
The Second Division of the Adjustment Board, upon the whole record and all
the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employes within the meaning of the Railway
Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
This claim is identical in all respects, including the respective parties,,
to Second Division Award 10077. For the reasons set forth in that Award, this
Board adopts its reasonings and conclusions and will deny this claim.
