Dispute: Claim of Employes:
1. That the National Railroad Passenger Corporation (Amtrak) violated the
current Agreement, particularly Rule 6(a) of the Bulletin and Assigwrrent
Rules, as long as it failed to bulletin a new position of Crane Operator
Electrician at the Diesel Shop, Beech Grove, Indiana.
2. That accordingly, the National Railroad Passenger Corporation (Amtrak)
unjustly deprived furloughed Electrician R. H. Baker of the additional
work opportunity as long as it failed to bulletin the aforementioned
Crane Operator Electrician position.
3. That accordingly, the National Railroad Passenger Corporation
(Amtrak) be ordered to compensate furloughed Electrician R. H. Baker
an additional eight (8) hours at the applicable straight time Crane
Operator Electricians rate each day the National Railroad Passenger
Corporation (Amtrak) improperly failed to bulletin the aforementioned
Crane Operator Electrician position, from May 14, 1982 continuously
until August 8, 1982, when the Railroad issued Bulletin No. IBEW No.
51, advertising position of Electrician/Crane Operator, Diesel Shop,
Beech Grove, Indiana; in order to make him whole and to protect the
Agreement.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Employes that the case be withdrawn.
