Findings:

The Second Division of the Adjustment Board, upon the whole record and all the evidence finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



Coach Cleaner Carol Emerick is employed at Carrier's King Street Station in Seattle, Washington. On November 16, 1979, she called in to say that she was sick and would not report to work.. In the two months prior to that date, she had been late ten times and absent from work 18 days. On one occasion just prior to the present incident, she was discovered to be on a pleasure trip when she was off. Because of her poor .record, Carrier determined that Claimant should be required to prove that she was i11 by submission of a Doctor's certificate verifying her illness. Claimant supplied a certificate and was allowed to continue to work.

Claimant subsequently filed a claim contending that Carrier should reimburse her for the fee for the Doctor's visit because she was singled out for special treatment. Claimant handled her case before this Board on her own.

The Board has reviewed the available record, considered the Claimant's plea in light of the Controlling Agreement, and can find no basis for her claim. We therefore shall dismiss it.
