1. That the Missouri Pacific Railroad Company violated Section 1 of the
Memorandum Agreement of December 7, 1953 by upgrading Cayman Helper in preference
to Car Apprentice S. Schwalbert starting October 23, 1981.
2. That the Missouri Pacific Railroad Company be ordered to make whole Car
Apprentice S. Schwalbert by compensating him the difference between what he was
paid as a Car Apprentice and what he would have made as a Cayman.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex pa rte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
