1. That the Missouri Pacific Railroad Company violated Rule 2, paragraph (d)
when they issued Bulletin No. 177 advertising job for Monday through Friday,
hours 12 Midnight to 8:00 A.M., in three (3) shift operation.
2. That the Missouri Pacific Railroad Company be ordered to return job to
11:00 P. M. to 7:00 A.M. and compensate Carman M. L. Purkey for one (1) hour at
the punative rate for each day he is forced to work this shift in violation of
the rules.
Statement: .
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parse form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
