1. That the Missouri Pacific Railroad Company violated Rule 2 (c) of the controlling Agreement at Fort Worth, Texas, January 28, 1982, when they arbitrarily changed the work shift at that point.

2. That the Missouri Pacific Railroad Company be ordered to compensate every carman required to work until 3:30 A.M. with thirty (30) minutes of the pro rata rate for each date so required and to return to a shift of 7:00 P.M. until 3:00 A. M. as prior to January 28 , 1982.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Carrier that the case be withdrawn.
