1. That the Missouri Pacific Railroad Company violated Rules 44, 102 and 103
of the controlling Agreement when they used outside contractor's forces to assist
Carmen at Fort Worth, Texas secure load on freight car MI 640229, April 2, 1982.
2. That the Missouri Pacific Railroad Company be ordered to compensate
Carmen H. A. Nuttal, Jr., M. L. Schultz, A. R. Delaney and K. W. Wright in the
amount .of four (4J hours at the pro rata rate.
Statement
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
