Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated Rule 24, of the
controlling Agreement when they refused to allow Carman O. Gonzalez to displace
setup Carman DeLeon at Bloomington, Texas, March 29, 1982.
2. That Carrier corresponding officer Master Mechanic J. S. Gray violated!
Rule 30 when he gave no reason for declining claim.
3. That the Missouri Pacific Railroad Company be ordered to compensate
Carman 0. Gonzalez in the amount for twelve (12) hours per day, five (5) days per
week, starting March 29, 1982 and
continuing until
violation is corrected.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
