Dispute: Claim of E3nployes:

1. That the Seaboard System Railroad Company (SCE) violated the Seaboard Coast Line current working Agreement, effective January 1, 1968, as amended, particularly Rules 1(a) and 29(a), when Carrier required and permitted a Signal Employee to perform work on September 30, 1980, belonging to Seaboard Coast Line Communications Maintainers.

2. That accordingly, the Seaboard System Railroad Company (SCL) compensate Communications Maintainer D. E. Butler two (2) hours and forty (40) minutes at: the overtime rate of pay.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Carrier that the case be withdrawn.
