1. That the Missouri Pacific Railroad Company violated Rules 119 and 120 of
the controlling Agreement when they used other than Carmen to rerail freight car
DUPX" 36932 in the yard limits at Bloomington, Texas, May 25, 1982. .
2. That the Missouri Pacific Railroad Company be ordered to compensate
Carman S. Lopez in the amount of four (4) hours at the punative rate.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte farm,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
