1. That the Missouri Pacific Railroad Company violated Rules 12(a) & (b) 22(a), 24(a), 117, and 137 of the controlling Agreement by assigning junior Carman B. J. Prater to vacant job at St. Genevieve, Missouri.

2. That the Missouri Pacific Railroad Company be ordered to compensate Carman J. E. Sultzer, Jr. for all wages and benefits lost starting August 24, 1982 and continuing until violation is corrected.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request frcyn the Carrier that the case be withdrawn.
