Dispute: Claim of Dmployes:

1. That the Grand Trunk Western Railroad Company violated the controlling agreement when Carman F. D. Pickens was assessed a sixty (60) calendar day suspension as a result of investigation conducted on December 16, 1982.

2. That accordingly, Grand Trunk Western Railroad Company be ordered to

compensate Carman F. D. Pickens for the sixty (60) calendar day suspension,

and make him whole for all benefits and privileges he would have

received during suspension and remove such discipline from his service

record.

STATEMENT

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the EMployes that the case be withdrawn.
