Dispute: Claim of Employes:
1. That under the current and controlling agreement, as amended, and the
provisions of the Retention Agreement, effective September 1, 1979, Laborer
G. C. Gerbing, Jr., I. D. No. 174036, was unjustly denied his rights
to exercise his seniority under the Retention of Seniority Agreement
to Waycross Shops, Waycross, Georgia.
2. That accordingly, Laborer G. C. Gerbing be restored to service with
the right to exercise his seniority in accord with the current provision
of the Retention of Seniority Agreement. Compensated for all lost
time, effective September 27, 1982. Vacation, health and welfare
benefits, hospital life and dental insurance premiums be paid, and
the payment of 10% interest rate be added thereto.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a request
from the Carrier that the case be withdrawn.
