1. That the Seaboard Coast Line Railroad Company violated the controlling
agreement when Carman T. C. Bailey was called from vacation to work
on the Florence Wrecking Crew in lieu of calling Carman J. R. Elliott
at Florence, South Carolina on February 24, 1978.
2. That accordingly, the Seaboard Coast Line Railroad Company be ordered
to compensate Carman Elliott in the amount of eleven (11) hours and
forty-eight (48) minutes at overtime rate of pay.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Carrier that the case be withdrawn.
