Dispute: Claim of Employes:

1. Reinstate to service with all seniority rights unimpaired.

2. Eight (8) hours of pay-five (5) days per week at straight time rate of: pay.

3. Any hours he may have worked at over time rate.

4. Interest of nine (9%) per cent on all compensation awarded, compounded annually on the anniversary date of claim.

5. Make claimant whole for all vacation rights.

6. Reimburse claimant any premiums which Carrier is required to pay.

7. Pay to claimant's beneficiary and/or estate whatever benefits the claimant has or may have accrued with regards to life insurance, for all time lost while claimant was improperly withheld from service of the railroad.

8. Pay claimant for all contractual holidays.

9. Pay claimant for all contractual sick days.

10. Make claimant whole for any and all contractual benefits in effect now or that may be in affect while claimant is unjustly withheld from service.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Carrier that the case be withdrawn.
