Claim filed on behalf of Machinist L. F. Melvin for 16 hours at the overtime rate account of Carrier utilizing a Carman to fill a supervisory position at the Enginehouse, Rocky Mount, N. C. on August 15 and September 13, 1981 in violation of the Agreement, particularly rule 29.
Statement:
The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Carrier that the case be withdrawn.
