Dispute: Claim of Employes:
1. That in the Waycross, Georgia Back Shop can July 9, 10, 13, 14, 15, 16,
17, 21, 22, 23, 24, 27, 28, 29, 30, 31, 1981 and August 11, 13, 14, 15, 1981,
the Seaboard System Railroad Ccmpany (SCL) violated the controlling Agreement
when Electrician Helper R. D. Harris was assigned to operate overhead Traveling
Crane instead of notifying overhead Traveling Crane Operator who was available
to operate the overhead Traveling Crane on the above mentioned dates.
2. That overhead Traveling Crane Operator B. R. William be compensated
eight (8) hours at the overtime rate of pay each day for the dates of July 9,
14, 21 , 23 , 28 , 31, 19 81 and August 13, 15 , 1981: Overhead Traveling Crane
Operator E. Mercer be compensated eight (8) hours at the overtime rate of pay
on each for (sic) the dates of July 10, 15, 16, 22, 24, 29, 1981 and August 11,
14, 1981: Overhead Traveling Crane Operator L. E. McCarthy be compensated eight
(8) hours at the overtime rate of pay on each of the dates July 13, 17, 30,
1981 by reason of Electrician Helper being wrongfully assigned to operate the
overhead traveling crane in violation of Rules 15, 95 and Appendix "Q" of the
current working agreement, as amended, when overhead electric traveling crane
operators were available.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Carrier that the case be withdrawn.
