Dispute: Claim of Employes:

"1) Restore the claimant to service with all seniority rights unimpaired.

2) Compensate the claimant for all time lost, this to include 6% interest per year until claim is settled.

3) Make claimant whole for all vacation rights.

4) Reimburse the claimant and/or his dependents for all medical expenses while employee was improperly withheld from service.

5) In case of claimant's death before claim is settled, pay to the claimant's estate whatever benefits he may have acquired before being withheld from service, and other benefits he may have acquired had he of not been improperly withheld from service, these being in regards to any group life insurance.

6) Pay claimant and/or estate for any or all contractual Holidays.

7) Pay claimant and/or estate for all sick pay which may be applicable or become applicable while claim is being handled.

8) Pay claimant and/or estate for any injury duty service pay he would have been entitled to had he not been improperly withheld from service."

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Parties in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Parties that the case be withdrawn.
