"1) Carmen Ron Burns and Dan McAtee were deprived of compensation
to which they are entitled when the Chicago & North Western
Transportation Company violated the controlling agreement,
specifically Rules 10, 17, 28, 29, 44, 53, and Carmen's Special
Rules 124 and 13.7, it assigned other than Carmen to repair freight
cars BCFX 146 XDE and TTPX 83669 at South Omaha on December 29, 1982.
2) That the Chicago & North Western Transportation Company be ordered
to compensate Carmen Ron Burns and Dan McAtee for two and
seven-tenths hours at the overtime rate of pay for violation of
December 29, 1982."
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Organization that the case be withdrawn.
AWARD
Claim dismissed.
