"1) Carmen Tony Rentereia and Tony Golland were deprived of compensation
to which they are entitled when the Chicago and North Western
Transportation Company violated the controlling agreement,
specifically Rules 10, 17, 28, 29, 53, 126 and 127 when it assigned
other than Carmen to assist in rerailing derailed freight cars
CTTX 700916, GTW 310466, ETTX 820387 and ETTX 903591 at Fremont,
Nebraska.
2) That the Chicago and North Western Transportation Company be
ordered to compensate Carmen Tony Rienteria and Tony Golland for
two and seven-tenths (2-7/10) hours at the overtime rate of pay
for violation on February 9, 1983.°
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Organization that the case be withdrawn.
