Dispute: Claim of Employes:
1. That the Burlington Northern Railway Company violated the terms
of Agreement, when they arbitrarily removed Dort Howery's name
from the Minot-Yellowstone District Seniority Roster and refused
to allow him to exercise his seniority on a permanent labor
position at Glendive, Montana.
2. That, accordingly, the Burlington Northern Railroad Company be
ordered to compensate Dort D. Howery in the amount of eight (8)
hours pay for his rate and class for each work day commencing
January 26, 1984 and continuing until properly assigned.
3. Further, that Dort D. Howery's name be placed in its proper
order on Minot-Yellowstone District Roster, and that he be made
whole for any other benefits he would have amassed during the
period of time he was denied employement.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Individual in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Individual that the case be withdrawn.

Claim dismissed.
