1. That under the current and controlling Firemen and Oiler's
Agreement, Laborer M. D. Carter was unjustly dismissed from
the service of the Seaboard System Railroad, Waycross,
Georgia, on July 23, 1984.
That accordingly, Laborer M. D. Carter be restored to his
assignment at Waycross Shops, Waycross, Georgia, with all
seniority rights unimpaired, vacation, health and welfare
benefits, hospital, life and dental insurance premiums be
paid and compensated for all lost time, effective July 23,
1984, and the payment of 10% interest rate be added
thereto.

The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the Organization that the case be withdrawn.
