"1. That the Illinois Central Gulf Railroad violated Rule 39 of the Section
"A" Agreement dated April 1, 1935, when, on October 7, 1983, they
improperly placed a letter of reprimand (discipline) on Machinist
A. F. Dawud's personal file account alleged improper work performance
without conducting an investigation.
2. That the Illinois Central Gulf Railroad violated Rule 39 of the
applicable Section "A" Agreement, when on March 16, 1984, they
assessed Machinist A. F. Dawud 30 work days suspension (March
17 - April 27, 1984) as result of investigation held March 8,
1984, account his alleged responsibility for improper application
of tt11 assembly on Locomotive 8033 on February 13, 1984.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the parties that the case be withdrawn.
