Dispute: Claim of Employes:
on or about March 31, 1982, Burlington Northern Railroad, hereinafter,
referred to as "Railroad," violated the rules of the controlling agreements in
that the claimants were refused housing allowances, pursuant to Paragraph F of
Section III of Implementing Agreement No. One between Burlington Northern Railroad, Inc. and its unions dated December 29 , 1967.
FINDINGS:
The Second Division of the Adjustment Board, upon the whole record
and all the evidence, finds that:
The carrier or carriers and the employe or.employes involved in this
dispute are respectively carrier and employes within the meaning of the
Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the
dispute involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
A review of the record in this case convinces us that the claim is
improperly advanced to this Board. On Petitioners' fa.llure to substantiate
their claim, this Board.must-dismiss the
matter.
