PARTIES TO DISPUTE:

STATEMENT OF CLAIM:

1. January 31, 1985, Carrier assigned Machinist J. C. Warmath and Electrician A. Manley, Jr., to clean out sand traps on diesel locomotive No. 1433. Violation of Rules 33, 107 and 108 of the Agreement.

2. Carrier continued to violate Rules, therefore, a continuing claim was entered.

3. Claim in behalf of Sheet Metal Workers' M. A. Sellers, etal., for a four (4) hour call.

FINDINGS:

The Second Division of the Adjustment Board upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



The Carrier assigned the work of cleaning out the sand traps on one of its locomotives located in Memphis to a Machinist and to an Electrician. The Organization claims the work.

Pursuant to Section 3, First (j) of the Railway Labor Act, as amended, notice was given to the International Association of Machinists & Aerospace Workers and the International Brotherhood of Electrical Workers of this claim as possible parties of interest. Both Organizations filed statements concerning this claim which are now included in the record before the Board.

The Board concludes, after a review of the record developed on the property, that there is insufficient probative evidence to support either the Carrier's or the organization's position.
