STATEMENT OF CLAIM:

Appeal of 60 day suspension of Chicago, Illinois Electrician Ms. Judith Hammond by the National Railroad Passenger Corporation pursuant to a notice of discipline dated September 9, 1987.

FINDINGS:

The Second Division of the Adjustment Board upon the whole record and all the evidence, finds that:

The carrier or carriers and the empToye or employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



The record shows that Claimant entered the service of the Carrier on September 4, 1979, and at the time of the disciplinary action involved in the dispute, held the position of Electrician at the Carrier's Chicago, Illinois, 16th Street Maintenance Facility.

By letter dated August 10, 1987, Claimant was notified to attend an Investigation on August 18, 1987, in connection with the charge of alleged violation of Rule "D" and Rule "F", Paragraph 3 of Carrier's Rules of Conduct, the alleged violation having occurred on July 21, 1987.

The Investigation was conducted on September 9, 1987. The Claimant was present at the Investigation and represented by a Representative of the Organization. Following the Investigation, by notice dated September 18, 1987, Claimant was assessed discipline of sixty working days suspension, thirty working days of which were deferred for one year.

The discipline assessed the Claimant was appealed in the regular manner on the property and denied by the Director-Labor Relations on February 11, 1988.

The Board has carefully considered the evidence adduced in the Investigation, and the correspondence covering the appeal on the property and we find no proper basis far disturbing the discipline assessed.
