PARTIES TO DISPUTE:
(Southern Pacific Transportation Company (Western Lines)

STATEMENT OF CLAIM:

1. That under the current Agreement Communications Department Equipment Installer K. E. Dolbee was unjustly treated when he was not reimbursed by Southern Pacific Transportation Company for a parking citation he received after being called to work in the middle of the night in a high crime area, where the employees parking area was locked up and unavailable.

2. That accordingly, the Southern Pacific Transportation Company be ordered to reimburse Equipment Installer K. E. Dolbee $28.00 for the parking citation he received on May 8, 1989.

FINDINGS:

The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

Parties to said dispute waived right of appearance at hearing thereon.

Claimant was called out to work late at night. When he arrived at his work location the parking lot was locked. He parked his vehicle on the street in front of the entrance, where parking is prohibited, instead of around the corner, where parking is allowed. His vehicle -was ticketed. He filed a Claim with the Carrier seeking reimbursement of the $28.00 fine.

Search of the record fails to develop any basis for support of this Claim. No rule or practice has been cited which suggests Carrier would be responsible for payment of the parking ticket. On the other hand Carrier has stated, without contradiction, that its policy is that employees do not receive reimbursement for any traffic fines or parking violations. Accordingly, the Claim must be denied.
