PARTIES TO DISPUTE:
                  (CSX Transportation, Inc. (former Chesapeake (& Ohio Railway Company)


STATEMENT OF CLAIM:

              "1. That the Chesapeake & Ohio Railroad Company (CSX Transportation, Inc.) (hereinafter referred to as 'carrier') violated the controlling Shop Crafts Agreement, specifically Rules 154, when the Carrier utilized members of the Machinist Craft to tram and gauge couplers on Locomotive Units 6427 and 2225 on June 24, 1990.


              2. That accordingly, the Carrier be ordered to additionally compensate Carman B. Oney in the amount of two (2) hours and forty (40) minutes pay at the applicable Carmen's rate of time and one-half for said violation."


FINDINGS:

The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

Parties to said dispute waived right of appearance at hearing thereon.

As Third Party in Interest, the International Association of Machinists and Aerospace Workers was advised of the pendency of this dispute, but did not file a Submission with the Board.

On August 8, 1990, the Organization presented this claim contending that its Agreement was violated when Machinists performed the work of tramming and gauging couplers on Locomotives 6427 and 2225 at the Russell, Kentucky, diesel maintenance facility. The evidence in this record supports the single conclusion that Machinists have historically done locomotive coupler tramming and gauging at this facility as a part of engine inspection. The Organization has not established an entitlement to this work.
