STATEMENT OF CLAIM:





FINDINGS:

The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier and employee within the meaning off the Railway Labor Act, as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

This dispute boils down to the Organization's assertion that non-scope covered employees were assigned to apply certain end of train ("EOT") devices at the Carrier's East Binghamton Yard. Application of these EOT devices is not specifically reserved to scope covered employees by rule. Nor is there a showing by the Organization that application of these EOT devices is performed by scope covered employees exclusively on a system wide basis.


The Organization has not carried its burden. The claim shall therefore be denied.








This Board, after consideration of the dispute identified above, hereby orders that an Award ffavorable to the Claimant(s) not be made.
