DISPUTE.-Request of employees that position of station Agent at East Moline be bulletuied and assigned to an employee carried on the Telegraphers' seniority list.
FINDINGS.-The Third division of the Adjustment Board, upon the whole record and all the evidence, finds that:
The carrier and the employees involved in this dispute are respectively carrier and employee within the meaning of the 1Cailway Labor Act as approved June 21, 1934.
This division of the Adjustment Board has jurisdiction over the dispute involved herein.
The parties to said dispute were given due notice of hearing thereon.Art agreement (hearing effective date .January 1, 1928) exists between the parties governing wages and working conditions of employees therein designated including position of Agent at East Moline, Illinois, at ° Monthly rate ($230.00) as full compensation for all services rendered."
Said position was vacated (not abolished) as of September 1, 1933, and the agency duties of the retiring incumbent were thereupon assigned to Agent at Rock Island-111oline, tile latter being a consolidated agency and one of the Supervisory class not coning within the scope of agreement between the parties.
The agreement cited does not permit of such transfer of assignment (as last above described) from a position coning within tire scope thereof to a like position conceded to be without the scope of same.
The carrier pray elect to continue or to discontinue the Agency at East Moline; and if the option to continue be exercised beyond fifteen days after the date of this Award, tile carrier is required to bulletin the position within the same fifteen-day period, and award the position to an employee subject to the terms of existing agreement between the parties and in the manner therein prescribed.
This Award shall not be construed to invade other constituted authority Upon. the maintenance of the Agency in question.
