DISPUTE.-" Reinstatement of J. E. Watson, Section Laborer, and pay for time lost-"
FINDINGS.-The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:
The carrier and the employee involved in this dispute are respectively carrier and employee within the meaning of the Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute involved herein.
The parties to said dispute waived right of appearance at hearing thereon.J. E. Watson entered the service of the Oklahoma City-Ada-Atoka Railway Company on June 14, 1928, and continued until December 10, 1934, when he was removed from service by Section Foreman W. B. Ray. The reason given by Foreman Ray for dismissing Mr. Watson was his failure to do his share of the work. Evidence indicates Mr. W atson was not entirely blameless.
There are mitigating circumstances in connection with this case that warrant Mr. Watson being given further consideration.
J. E. Watson shall be reinstated in service as Section Laborer with seniority rights unimpaired, but without pay for time lost. By Order of Third Division:
