THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY

DISPUTE.=`Claim of General Committee of The Order of Railroad Telegraphers, on the Atchison, Topeka, and Santa Fe Lines, that the CashierTelegrapher at Rice, California, is being excused from duty each Monday in violation of Article 17, paragraph (a) of the Telegraphers' Schedule, and that the incumbent of this position be compensated in money (under the Guarantee contained in Article 17-(a) ), for each Monday he is so excused."

FINDINGS.-The Third Division of the Adjustment Board finds that-

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.

No hearing thereon has been had and under date of November 7, 1935, the complainant party addressed a formal communication to the Secretary of the Third Division containing the request "that our ex parte submission in this case be withdrawn from before your Board, without prejudice to the principle involved."



Case dismissed.
