PARTIES TO DISPUTE:



DI$PUTE.=`(1) That W. H. Thomas should have seniority rights as train dispatcher dating from October 16, 1917, and be permitted to exercise same to dispatcher positions In the seniority territory.

"(2) That W. H. Thomas be paid by the carrier for net wage loss sustained by him, because the carrier failed to permit him to exercise his train dispatcher's seniority."

FINDINGS.-The Third Division of the Adjustment Board finds that-

The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party.

No hearing thereon has been had and under date of January 13, 1936, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.



Case dismissed.
