PARTIES TO DISPUTE:




DISPUTE.-"Claim of incumbent of position of Freight Clerk, Richmond Hill, N. Y., for compensation at overtime rates, as provided in Regulation 4-A-1 of Clerks' Schedule, on the actual minute basis, for all time in excess of eight (8) hours, exclusive of a meal period of not to exceed one hour, from time required to first report for duty to the time of final release since May 21st, 1935."

FINDINGS.-The Third Division of the Adjustment Board finds that-

The dispute was certified to the Third Division of the Adjustment Board ex parte b3' complainant party.

No hearing thereon has been had and under date of January 20, 1936, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
