PARTIES TO DISPUTE:


DISPUTE.-"Claim by the train dispatchers that the seniority roster for the Salamanca, N. Y., Dispatching office show the names of all those who under the rules of the current Train Dispatchers' Agreement, hold seniority rights as trail dispatcher to positions in that dispatching office; that such names be dove-tailed according to the seniority standing of each, and that the train dispatchers be permitted to place themselves on dispatcher positions in the Salamanca Dispatching office in accordance therewith."




Under date of September 2, 1935, this Third Division of the National Railroad Adjustment Board rendered Award No. 85 in the above entitled dispute which said award is herein referred to and made a part of this supplemental award.

It further appearing to this Division that under date of November 2, 1935. a representative of the American Train Dispatchers Association and a superintendent of the carrier in this dispute met in conference in Salamanca, N. Y., and conferred as was required by said award and the results of such conference were conveyed to this Division, and it further appearing that the representatives of the respective parties involved in said award were and are unable to arrive at a satisfactory arrangement of the positions, and it farther appearing to this Division that the ends of justice, as well as the spirit and intent of the agreement between the parties will be defeated unless further action is taken by this Division, now, therefore, this Division makes and adopts this supplemental award.




Inasmuch as the representatives of the parties to this dispute have, after a conference, been unable to agree, it is ordered by this Division that the names of all the dispatchers holding seniority rights to positions in the Erie Railroad dispatchers' office located at Salamanca shall be dovetailed according to seniority standing into one common roster and that hereafter such train dispatchers will be permitted to place themselves on dispatcher positions in accordance with Rule 6 (C) of the Agreement between the parties.
