"Claim of the clerical employees that the position of Accountant in the office of Chief Engineer, Maintenance of Way and Structures, Cincinnati, Ohio, be restored and bulletined as provided in the rules of the Clerks' Agreement and that the clerk assigned be reimbursed for all monetary loss suffered as of September 26, 1935."
FINDINGS.-The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:
The carrier and the employees involved in this dispute are respectively carrier and employees within the meaning of the Railway Labor Act, as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute involved herein.
The parties to said dispute were given due notice of hearing thereon.Hearing on this dispute began December 1, 1936, and is not as yet concluded, the parties, at their request, being granted additional time in which to supplement their statements. Under date of January 13, 1937, the complainant party, through formal communication, advised the Secretary of the Third Division of his desire to withdraw it from further consideration by the Division. This dispute being in the form of a joint submission, and the request having been concurred in by the carrier, it is hereby granted.
